ההוא גברא דאמר ליה לחבריה מאי בעית בהאי ארעא

א"ל מינך זבנת' ואכלתה שני חזקה

א"ל אנא בשכוני גואי הואי

אתא לדינא לקמיה דרב נחמן

א"ל זיל ברור אכילתך

א"ל רבא דינא הכי המוציא מחבירו עליו הראיה

A certain man said to another, 'What right have you in this field {our gemara: house}?'

He said to him: 'I bought it from you, and I have had the use of it for a period of chazakah {=three years}.

He said to him: I was dwelling within {in an inner room}.

This came to judgment before Rav Nachman. He said to him {the defendant}: You must prove that you have had constant use of the house.

Rava said: Is the law such? {Rather}, one who wishes to take from his fellow, upon him is the burden of proof.

ורמינן דרבא אדרבא ודרב נחמן אדרב נחמן

דההוא דא"ל לחבריה כל נכסי דבי בר סיסין מזבנינא לך

הואי ההיא ארעא דמיקריא דבי בר סיסין

And we contrast Rava upon Rava, and Rav Nachman upon Rav Nachman. For there was someone {Bava Batra 30a} who said to his fellow, "all the assets of the house of Bar Sisin I will sell yo you." There was a piece of land which was called Bar Sisin's. He said to him "give me of it." He said to him: 'This is not really the property of Bar Sisin though it is called Bar Sisin's.'

This came before Rav Nachman. He established it in the hand of the purchaser.

Rava said to him: Is the law indeed so? One who takes out from his fellow, upon him is the onus of proof.

This is a contradiction between Rava and Rava, and a contradiction between Rav Nachman and Rav Nachman.

דרבא אדרבא לא קשיא התם מוכר קאי בנכסי הכא לוקח קאי בנכסי

דר"נ אדר"נ נמי לא קשיא כיון דכ"ע קרו ליה דבי בר סיסין והאי הוא דא"ל לאו דבי בר סיסין היא עליה רמי לגלויי דלאו דבי בר סיסין היא

Between the two remarks of Rava there is no contradiction. In the latter case the seller is in possession; in the former the purchaser is in possession. Neither is there any contradiction between the two rulings of Rav Nachman. {In the latter case,} since the seller professed to sell the property of Bar Sisin's and this land is called Bar Sisin's, it is for him to prove that it is not Bar Sisin's, but here let the occupier {in pleading presumptive right} be but treated as if he produced a document of sale, in which case should we not say to him: 'Prove your document to be valid and you can remain in ownership of the property'?

וקא פסק הלכתא בהאי מעשה ובמעשה דבי סיסין כרבא

This incident of "dwelling in the inner rooms" {of 29a and 159b}, we have seen in it two explanations. There is one who explains that the complainer does not have witnesses that this land is his. For if he had witnesses that this land was him, while the other one says "I bought it and consumed the years of chazaka", Rava would not say in such a situation that one who tries to get out from his fellow, upon him is the burden of proof. For behold, Rava himself is the one who says in such a situation that the purchaser needs to bring witnesses that he consumed the years of chazaka, for Rava said that it must be such as where a set of two came and said "we rented it from him and dwelled in it three years during the day and night." And if so, how could Rava said that if one wishes to take out from his fellow, upon him is the burden of proof?

Rather, in this incident, we can only establish it such that the complainant lacks witnesses who know that this land is his, but rather it is the purchaser who says that it was his, but that he purchased it from him. Such that it is the mouth that forbids is the same mouth that permits. And because of this, Rava said that one who wishes to take from his fellow {=the complainant}, upon him is the burden of proof.

And Rav Nachman maintains that even though this one lacks witnesses that the land is his, the purchaser has admitted that it was his, and says that he purchased it from him and consumed the years of chazaka, he needs to bring witnesses that he consumed the years of chazaka.

And he {=this person who interprets the gemara this way} decides the halacha in this incident, and in the incident of Bei Sisin like Rava.

ואיכא מאן דאמר דהאי מעשה ליכא לאוקמיה בכה"ג

And there is one who says that we cannot establish this incident as discussing this particular scenario. For where there are no witnesses that this land belonged to the complainant, all agree that the purchaser does not need to bring a proof, and even though he says that the years of chazaka were not consumed, we do not take it away from him. And all the more so where he says that the years of chazaka were consumed. As we say via this that we learned {in the Mishna}, "And Rabbi Yehoshua admits that where he says to his fellow, 'this field belonged to your father and I purchased it from him,' he is believed, for the mouth that forbids is the same mouth that permits."

And we say upon it: And let us teach {in the Mishna} "And Rabbi Yehoshua admits that where he says to his fellow, 'this field belonged to you and I purchased it from him,' he is believed, for the mouth that forbids is the same mouth that permits"? And we answer that this is because we need to teach and if there are witnesses that it is his, and he says "I purchased it from him," he is not believed. How so? If the years of chazaka were consumed, why is he not believed. And if the years of chazaka were not consumed, it is obvious that he is not believed!

And we derive from there that where he said "this field was yours, and I purchased it from you, he is believed, even where the years of chazaka are not in his hand. And in this matter, all the Tannaim agree, and there is not one who disputes it. And if so, how can we establish Rav Nachman as arguing upon it?

אלא האי מעשה הכין פירושא כגון דהאי ארעא ידיעא וברירא דלהאי מערער הות וא"ל להאי מחזיק מאי בעית בהאי ארעא וא"ל מינך זבינתה ואכלתה שני חזקה אמר ליה היאך זבינתה מינאי ואנא בשכוני גואי ולא הוינא בהדך במתא בההוא עידנא ואת טעין דזבינתה מינאי

Rather, this is the explanation of this incident. Such that this land was known and well-established as belonging to the complainant. And he says the the machzik, "what are you doing on this land?" And he says to him, "I purchased it from you, and the years of chazaka have been consumed." He said to him, "how have you purchased it from me, when I was dwelling within, and I was not by you in the town at that time, while you plead that you purchased it from me!?"

Rav Nachman said to him: Go and establish your consumption, that consumption that you established there is a chazaka, and we can establish the land in your possession.

That is, bring witnesses that you and this seller were in the town, even one day, such that your consumption can be called a consumption, for it is possible to you that you purchased it from him on that day. Otherwise, your years of chazaka are like a chazaka which don't have a {possibility of} complaint with it {such that the chazaka is invalid}.

Rava said to him: Is the law indeed so? Rather, one who tries to take from his fellow, upon him is the burden of proof. For Rava maintains that the complainant is the one who needs to bring witnesses that he was not in the town on that day, for he is pleading against the one to whom he sold.

And Rav Nachman said that this is not so. Rather, if one takes a deed in his hand that he bought it from him on a certain day, do we not tell him "establish your deed and stay with your assets?" And all the more so here, that we say to him {the purchaser} "bring witnesses that he was with you in the town, such that you can say that "I purchased it from him."

And we establish like Rav Nachman in both of them, in this incident and in the incident of Bei Bar Sisin. For Rava in this matter was a student, for he was sitting before Rav Nachman. And the halacha is not like a student in place of the teacher. And all the more so that we establish this as the maaseh rav in these two cases.

באתרא דמוברי באגי דלא בעינן רצופות ואע"ג דאיכא דמובר ואיכא דזרע מצי אמר הכי ניחא לי דעבדא טפי

in places where it is customary to leave fields fallow that we do not require uninterrupted years. And even though some leave it fallow and some plant, he is able to say "I prefer this way, because it makes the field more productive.'

תנן חזקת הבתים והא בתים דביממא ידיע בליליא לא ידיע

אמר אביי מאן מסהיד אבתים שיבבי שיבבי מידע ידעי בין ביממא בין בליליא

רבא אמר כגון דאתו בי תרי ואמרי אנן אגרינן מיניה ודרנא בה תלת שנין ביממא ובליליא

They learn {in a Mishna} "PRESUMPTIVE TITLE TO HOUSES". There are houses in the case of houses we can know if a man lives there by day but not if he lives there by night!

Abaye said: Who is it that testifies to {a man having lived in} a house? — The neighbors; and the neighbors know whether he has lived in it by night as well as by day.

Rava said: For instance, two persons come forward and say, We hired the house from him and lived in it day and night for three years.

א"ל רב יימר לרב אשי והא נוגעין בעדותן נינהו דאי לא אמרי הכי אמרינן להו זילו הבו ליה אגר ביתא להאי

א"ל דייני דשפילי הכי דייני מי לא עסקינן דנקטי אגרא בידייהו ואמרו למאן ניתבוה

Rav Yemar said to Rav Ashi: But these men are interested witnesses, because if they do not make this assertion we shall tell them to go and pay the rent to the claimant?

He {=Rav Ashi} said to him: Only incompetent judges would proceed thus. Are we not dealing with a case where they come with the rent in their hands and say "to whom do we give it?"

Mar Zutra said: If the claimant demands that two witnesses should be produced to testify that the occupier lived in the house three years day and night, his demand is valid.

{Bava Batra 29b}

And Mar Zutra admits that where the claimant is an itinerant peddler, even if he does not raise the plea, the court raises it for him. And Rav Huna admits in the case of the shops of Machoza {that it is not necessary}, because they are only used by day and not by night.

Rami bar Chama and Rav Ukva bar Chama bought a maidservant in partnership, the arrangement being that one should have her services during the first, third and fifth years, and the other during the second, fourth and sixth. Their title to her was contested. They came before Raba. He said to them: Why did you make this arrangement? So that neither of you should obtain a presumptive right against the other. And just as you have no presumptive right against each other, so you have no presumptive right against outsiders.

And these words are where there was not written agreement, but where there was a written agreement, there would be a voice to it.

אמר רבא אכלה כולה חוץ מבית רובע קנאה כולה חוץ מבית רובע

א"ר הונא בריה דרב יהושע לא אמרן אלא דבר זריעה הוא אבל לאו בר זריעה הוא קני ליה אגב ארעא

Rava said: If the occupier has eaten {=occupied} the whole field except the space of the sowing of a quarter of a kav, he acquires ownership {after three years} of the whole field with the exception of that quarter of a kav.

Rav Huna son of Rav Yehoshua said: We only say this if it was suitable for sowing, but if it was not suitable for sowing, he acquires it via the {rest of the} land.

Rav Bibi bar Abaye objected to it: If that is so, how does a man acquire a piece of rock {through occupation}? Is it not by stationing his animals there and laying out his crops there? So here too, he should have stationed his animals there and laid out his crops there.

And so is the halacha.

IF A MAN'S TREE OVERHANGS HIS NEIGHBOR'S FIELD, THE LATTER MAY CUT AWAY THE BRANCHES TO A HEIGHT SUFFICIENT TO ALLOW HIM TO USE THE OXGOAD OVER THE PLOW.

IF THE TREE IS A CAROB OR SYCAMORE, HE CAN CUT DOWN {ALL THE BRANCHES} PLUMB {WITH THE BOUNDARY}.

IF THE FIELD IS AN IRRIGATED ONE, {THE BRANCHES OF ALL} TREES MAY BE CUT DOWN PLUMB.

ABBA SHAUL SAYS THAT THE BRANCHES OF ANY WILD FRUIT-BEARING TREE CAN BE CUT DOWN PLUMB.

IF A TREE OVERHANGS A PUBLIC THOROUGHFARE THE BRANCHES SHOULD BE CUT AWAY TO A HEIGHT SUFFICIENT TO ALLOW A CAMEL TO PASS UNDERNEATH WITH ITS RIDER.

RABBI YEHUDAH SAYS, SUFFICIENT FOR A CAMEL LADEN WITH FLAX OR BUNDLES OF VINE-RODS.

RABBI SHIMON SAYS THAT {THE BRANCHES OF} ALL TREES SHOULD BE CUT AWAY PLUMB {WITH THE STREET} TO GUARD AGAINST UNCLEANNESS.

A presumptive title is acquired in three years. What is the reason?

{Bava Batra 29a}

Rava said: For the first year a man takes care of his title-deed, and so for two, three years does he take care; beyond that he does not take care.

Abaye said to him: If so, a protest made not in the presence of the holder is no protest, since the latter can say, 'If you had protested to me personally, I should have taken more care of my title-deed'? — The other can retort, '{You must have known of my protest because} your friend has a friend and your friend's friend has a friend.

Rav Huna said: The three years mentioned in the Mishnah only count if the occupier took the crops in all three successively.

רבי יוסי במשרה וירק וכרישין ובצלין ליכא היזקא דלא מודה ביה רבי יוסי

דלא ליתיה להיזקא דהני אלא לאחר זמן כענין זה חופר בתוך שלו וזה נוטע בתוך שלו

And if Rabbi Yossi admits by flaxwater and vegetables, and leeks and onions, then there is no damage in which Rabbi Yossi does not admit. In all [בכל] there is no damage to these except after a time, in the manner of this one digging within his own and this one

ולענין חרדל ודבורים נמי מסתברא לן דהלכתא כותיה

And in terms of mustard and bees as well, it is logical to us that the halacha is like him {Rabbi Yossi}. For behold we establish the Mishna as referring to a purchaser, and there is not one of them who precedes. For what have you? If we maintain like the Sages who say that bees do not damage mustard but that it is mustard which damages bees, even so the halacha is like Rabbi Yossi, for it is not his caused damage {girei}, because there is not one of them who preceded.

And furthermore, even if the owner of the bees preceded, it is not the girei of the owner of the mustard, for when he throws the grains in the dirt, they will not find it, and if after it is removed, it is neither caused girei or the gerama of girei, but rather mere gerama. Therefore, the halacha is like Rabbi Yossi in the entire Mishna, whether by flaxwater and vegetables or mustard and bees. And as Ravina, who is the latest position, explained.

However, he certainly needs to distance flaxwater from vegetables so that it will not be girei {his arrows -- direct action damaging}, just as one distances a pit, well, cistern and water channel, etc., so that it will not be his arrows {damaging}. For in all of our chapter, Rabbi Yossi admits, for Rabbi Yossi admits by his arrows, that if he does not distance this distance, they are his arrows of the indirect result of his arrows {and he is responsible for the damage}.

Mishna:

מרחיקין את האילן מן הבור עשרים וחמש אמה ובחרוב ובשקמה חמשים אמה בין מלמעלה בין מלמטה בין מן הצד

אם הבור קדמה קוצץ ונותן דמים

ואם האילן קדם לא יקוץ

ספק זה קדם וספק זה קדם לא יקוץ

ר' יוסי אומר אע"פ שהבור קדם לא יקוץ שזה חופר בתוך שלו וזה נוטע בתוך שלו:

RABBI YOSSI SAYS THAT EVEN IF THE PIT WAS THERE BEFORE THE TREE THE OWNER CANNOT HAVE THE TREE CUT DOWN, BECAUSE THIS ONE DIGS IN HIS PROPERTY, THE OTHER PLANTS IN HIS.

Rav Yehuda cited Shmuel: The halacha is like Rabbi Yossi.

Rav Ashi said: When we were in the academy of Rav Kahana, we would say that Rabbi Yossi admits by his arrows {causing damage}.

Rav Papa Yochnaah was a pauper and became wealthy. He built a country-house. In his neighborhood were some sesame-oil makers who, when they crushed the sesame seeds, used to make his villa shake.

He came before Rav Ashi. He {=Rav Ashi} said to them: When we were in the academy of Rav Kahana, we would say that Rabbi Yossi admits by his arrows.

And how much must it shake {to constitute damage}? Enough to make the lid of a pitcher rattle.

When the people in the house of Bar Marion the son of Rav Avin used to beat flax, the dust used to fly about and damage people. They came {in a courtcase} before Ravina.

He said to them: When we say that Rabbi Yossi admits by his arrows, these words are where where he himself sets the cause of the damage in motion. Here it is the wind which carries the dust about.

Mar bar Rav Ashi objected to him: How do these man differ from a man winnowing {on Shabbat} when the wind aids him?

The Sages said this before Mereimar. He said to them: This is the same as the man winnowing {on Sabbath} when the wind comes and helps him.

And so is the halacha.

וה"מ לענין איסורא דאסור למגרם היזקא לאינשי כדאמרינן גרמא בנזקין אסור

אבל לענין תשלומין פטור דגרסינן בפרק הכונס צאן לדיר אמר רב אשי כי אמרינן זורה ורוח מסייעתו ה"מ לענין שבת דמלאכת מחשבת אסרה תורה אבל הכא גרמא בעלמא הוא וגרמא בנזקין פטור:

And these words are in terms of the prohibition, for it is forbidden to cause damage to people, as we have said that indirect cause in damages is prohibited. But in terms of recompense, he is exempt, for we learn in perek Hakones Tzon LaDir: Rav Ashi said: When do we say that this is the same as a man winnowing and the wind helping him? In terms of Shabbat, for it is a melechet machshevet {an act carried out with thought or intention} which the Torah forbids. But here, it is mere indirect cause, and indirect cause by damages, he is exempt {from paying}.

אחד גפנים ואחד כל האילן

A MAN SHOULD NOT PLANT A TREE [IN HIS OWN FIELD] CLOSE TO HIS NEIGHBOR'S FIELD UNLESS HE KEEPS IT AT A DISTANCE OF FOUR CUBITS; THIS APPLIES BOTH TO A VINE AND TO ALL OTHER TREES.

IF THERE IS A FENCE BETWEEN THE TWO FIELDS, EACH MAY PLANT CLOSE UP TO THE FENCE ON HIS OWN SIDE.

IF THE ROOTS {OF ONE MAN'S TREE} SPREAD INTO HIS NEIGHBOR'S FIELD, HE {=THE LATTER} CAN CUT THEM AWAY TO A DEPTH OF THREE HANDBREADTHS SO THAT THEY SHOULD NOT IMPEDE THE PLOW.

IF HE DIGS A PIT, DITCH, OR CAVE, HE CAN CUT RIGHT DOWN {TO ANY DEPTH}. AND THE WOOD BELONGS TO HIM.

They learnt {in a brayta}: The four cubits of which they spoke are to allow working the vineyard.

Shmuel said: They only learned this in the land of Israel. But in Babylonia, two cubits.

A brayta also says so:

A man should not plant a tree nearer than two cubits to his neighbour's field.

They learnt {in a brayta}: Rabbi Yossi permits. For he is able to say to him "before you tell me 'distance your mustard from my bees', you distance your bees from my mustard, for they come and eat the twigs {of the mustard plants}.
Mustard, the reason of the Sages is that it is certainly upon the damager to distance himself. Therefore, we distance the flaxwater from the vegetables, the leeks from onions, and the mustard from the bees. And Rabbi Yossi maintains that it is upon the damaged party to remove himself, such that even regarding flaxwater and vegetables, they do not need to distance it. And this that we teach that Rabbi Yossi permits by mustard, he is stating that within the position of the Sages. He is saying to them: According to me, it is upon the damaged party to distance himself, such that for all of them, they do not require distancing. But according to you, that you say that it is upon the damager to distance himself, this is fine in regards to flaxwater and vegatables, for these damage those, while those do not damage these. But mustard and bees, each of them damage the other.

And the Sages: Bees do not damage mustard. If the grains {of mustard}, they do not find it. If its leaves, they will regrow.

And we establish like Rabbi Yossi.

וחזינן בפירושא דגאון דלית הלכתא כר' יוסי בחרדל ודבורים

And we have seen in the commentary of the Gaon that the halacha is not like Rabbi Yossi by the mustard and bees. And he says as well that in terms of flaxwater and vegetables, Rabbi Yossi admits that we distance. And only in the reason of the matter does Rabbi Yossi argue, and not in the substance of the law.

And to us, this explanation is difficult. For when you consider the gemara, you find regarding Rabbi Yossi that in the substance of the law he argues. For: this is what it means to say: according to me, even flaxwater and vegetables also do not require distancing. And this that it states that Rabbi Yossi admits by damage he caused and by gerama {indirect cause} of his damage. For caused damage there certainly is there. But here, by flaxwater and vegetables, there is neither caused damage nor indirectly caused damage, for the water will dry up and it will then go.

For a purchaser it is necessary.
A purchaser, we have also taught it:

'If a man buys a courtyard in which are beams and balconies projecting over the main thoroughfare, he has a legal right to retain them.'

It is necessary. For if I had only the statement regarding the main thoroughfare to go by, I should say that the reason there is that it {the courtyard} had been originally drawn back {from the main thoroughfare} into his own. But by a pigeon cote, where one cannot say this, I would say no. And if I had only the statement by the pigeon cote, since it is the private domain, I would say that he appeased him, or alternatively, the other waived his right in his favor. But in a public domain, who waived their right to the seller, and who does he appease? Therefore it is necessary.

Rav Yosef has certain small date trees {Bava Batra 23a} under which cuppers used to sit {and let blood}, and ravens used to collect to suck up the blood, and they used to fly on to the date trees and damage them.

Rav Yosef said to them {the cuppers}: Take away your croakers from here.

Abaye said to him: But it is an indirect cause?

"But Rav Tovi bar Kisna cited Rav Matna who cited Rav: This effectively states that indirect cause by damages is prohibited."

"But he granted them the right {to let blood under the trees; or: they have established the right}?"

"But Rav Nachman cited Rabba bar Abahu: There is no title to cause damages."

"But do we not state upon it: Rav Mari said: regarding smoke; and Rav Zevid said: in the privy?"

He {=Rav Yosef} said to him: 'I am very sensitive, and these ravens are {as offensive} to me as smoke or a privy.'

And the first one, how close was it? Rav Yehuda said: This is what is means to say: {Bava Batra 22b} "If a man wants to build a wall alongside of his neighbor's wall, he must not do so unless he keeps it [at least] four cubits away."

Rava said: But the Mishna taught, "one who had his wall close to the wall of his fellow!"

Rather, Rava said, this is what it means to say: "If a man had a wall running alongside of his neighbour's wall at a distance of four cubits and it falls down, he must not bring another wall alongside unless he keeps it four cubits away."

What is the reason? The treading of the earth between is good for the walls.

Rav said: They only learned this regarding the wall of a vegetable garden, but the wall of a courtyard, if he comes the build alongside, he may build alongside.

And Rav Oshaya said: Whether the wall of a vegetable garden or the wall of a courtyard, if he comes to build alongside, he may not build alongside.

R' Yossi bar Chanina said: And they do not argue. This one in a new town and this one in an old town.

"IF THERE ARE WINDOWS, WHETHER ABOVE OR BELOW...":

A tanna taught: a space must be left 'above' so that he should not be able to peep into the other one's room, and 'below' so that he should not stand on tiptoe and look in, and 'opposite' so that he should not take away his light.

(* The reason is that he should not take away his light, but because the ground should be trodden, no? What are we dealing with? Where he comes from the side {at right angles}. *)

And how much is such that he should not take away his light?

Rav Yeva, the father-in-law of Ashian bar Nadvach said in the name of Rav: The breadth of a window. And how much is that? A handbreadth.

And he needs to slope his wall so that one cannot stand on it and peer in.

Where are these words said? From the side and from one direction, but from two directions {it must be a distance of} four cubits.

Mishna:

A LADDER MUST BE KEPT AWAY FROM A PIGEON COTE FOUR CUBITS SO THAT A WEASEL SHOULD NOT BE ABLE TO SPRING {FROM THE LADDER ON TO THE COTE}.

AND THE WALL MUST BE KEPT FOUR CUBITS FROM THE {NEIGHBOR'S} ROOF-GUTTER SO AS TO ALLOW ROOM FOR SETTING A LADDER.

A PIGEON COTE MUST BE KEPT FIFTY CUBITS FROM A TOWN.

MAN SHOULD NOT PUT UP A PIGEON COTE ON HIS OWN ESTATE UNLESS THERE IS A CLEAR SPACE OF FIFTY CUBITS ALL ROUND.

RABBI YEHUDA SAYS, THE SPACE SHOULD BE SUFFICIENT FOR THE SOWING OF FOUR KOR, WHICH IS AS MUCH AS A BIRD FLIES AT A TIME. IF, HOWEVER, HE BUYS IT {FROM ANOTHER} WITH ONLY THE SPACE FOR SOWING A QUARTER OF A KAB ROUND IT, HE HAS A RIGHT TO KEEP IT.

Rav Huna said: If a resident of an alley sets up a handmill and another resident of the alley wants to set up one next to him, the first has the right to stop him, because he can say to him, 'You are interfering with my livelihood.'

They objected {from a brayta}:

'A man may open a shop next to another man's shop or a bath next to another man's bath, and the latter cannot object. because he can say to him, I do what I like in my property and you do what you like in yours?'

It is a matter of Tannaitic dispute. For they learnt {in a brayta}:

The residents of an alley can prevent one another from bringing in a tailor or a tanner or a teacher or any other craftsman, but to a neighbor, they cannot prevent.
R' Shimon ben Gamliel says: They can even prevent a neighbor.

And we do not rule like Rav Huna, for he maintains like an individual {a yachid}, and the halacha is always like the setam. And furthermore, because of this of Rav Huna son of Rav Yehoshua, who is later, who argues on him.

For Rav Huna son of Rav Yehoshua said: It is quite clear to me that the resident of one town can prevent the resident of another town, but if he he pays taxes to that town, he cannot prevent. {And} the resident of an alley cannot prevent another resident of the same alley.

Rav Huna son of Rav Yehoshua inquired: Can the resident of one alley prevent the resident of another alley?

The question stands unresolved. Therefore, he is not able to prevent.

Rav Yosef said: And Rav Huna admits regarding a teacher of schoolchildren, that he cannot prevent. For Master said:

Rav Nachman bar Yitzchak said: And Rav Huna son of Rav Yehoshua admits regarding itinerant spice-sellers who travel between towns that they cannot prevent one another. For Master said: Ezra made a rule for Israel that spice-sellers should go about from town to town.

A MAN, HOWEVER, MAY MAKE ARTICLES IN THE COURTYARD TO TAKE OUT AND SELL IN THE MARKET, AND HIS NEIGHBOUR CANNOT PREVENT HIM ON THE GROUND THAT HE CANNOT SLEEP FROM THE NOISE OF THE HAMMER OR OF THE MILL-STONES OR OF THE CHILDREN.

A tanna taught: If the cowshed is there before the storehouse, it is permitted {to be opened}.

A tanna taught: They declared it permissible in the case of wine because it {the smoke} improves it, while they forbade a cowshed because it {=the smell} spoils it.

Rav Yosef said: Our wine is adversely affected even by the smoke of a lamp.

Rav Sheshet said: Cropped grain is on the same footing as a cowshed.

And Rav said to Rav Shmuel bar Shelat: When you punish a pupil, only hit him with a shoe latchet. The attentive one will read {of himself}, and if one is inattentive, put him next to a diligent one.

אמר רבא מתקנת יהושע בן גמלא ואילך לא ממטינן ינוקא ממתא למתא אבל מבי כנישתא לבי כנישתא ממטינן ואי מפסיק נהרא לא ממטינן ואי איכא תיתורא ממטינן גמלא לא ממטינן זימנין דמיקרי ונפל

Rava said: Under the ordinance of Yehoshua ben Gamla, children are not to be sent {every day to school} from one town to another, but they can be compelled to go from one synagogue to another {in the same town}. If, however, there is a river in between, we cannot compel them. But if, again. there is a bridge, we can compel them — not, however, if it is merely a plank. For there are times in which a mishap will occur and he will fall.

Rava said: The number of pupils to be assigned to each teacher is twenty-five. If there are fifty, we appoint two teachers. If there are forty, we appoint an assistant, at the expense of the town.

Rava said: If we have a teacher who reads {/gets on} with the children and there is another who can get on better, we do not replace the first by the second, for fear that the second when appointed will become indolent.

And Rav Dimi of Nehardea said: All the more so, that he will exert himself more. For master said: 'the jealousy of scribes increaseth wisdom.'

And Rava said: If there are two teachers of whom one gets on fast but with mistakes and the other slowly but without mistakes, we appoint the one who gets on fast and makes mistakes, since the mistakes go out by themselves {=correct themselves in time}.

Rav Dimi of Nehardea said: We appoint the one who goes slowly but makes no mistakes, for once a mistake is implanted it has entered.

Resh Lakish cited Rabbi Yehuda Nesia: The world only is sustained because of the mist of the breath of schoolchildren.

Rav Pappa said to Abaye: Yours and mine, what of it?

He {=Abaye} said to him: Mist {of the breath} of one who has no sin is not comparable to the mist of one who has sin.

And Resh Lakish cited Rabbi Yehuda Nesia: We do not cause neglect of Torah by schoolchildren, even for the building of the Temple.

And Resh Lakish cited Rabbi Yehuda Nesia: So I have received as tradition from my ancestors: Any city which lacks schoolchildren, they destroy it; and some say {the textual variant} they place it under the ban.

{Bava Batra 21b}

Rava said: A schoolteacher who negligently teaches the children, a vine-dresser who ruins the vine, a butcher who renders the animal a neveila, [and a craftsman] and a scribe of the town who erred, we remove them without warning. What is the reason? All of them stand as if the have been warned.

The general rule of the matter is that any damage which cannot be undone are standing as if warned.

A brayta also says so: The fuller's pool must be kept four cubits away.

Shmuel said: A thin wafer does not narrow a window space.

They objected: If a basket full of straw or a jar full of dry figs is placed in a window space, then we see: If when they {= the basket and the jar} are taken away the straw and the figs can stand by themselves, then they form a partition, but if not, they do not form a partition.

With moldy straw.

But figs are fit for him {to eat}?

RABBI SHIMON SAYS: ALL THESE LIMITATIONS WERE ONLY LAID DOWN WITH THE IDEA THAT IF AFTER OBSERVING THEM HE STILL CAUSES DAMAGE, HE IS NOT LIABLE TO PAY.

Rav Huna wrote 70 sifrei Torah, and hit the measurement only once.

פתח בבור וסיים בכותל ליתני אא"כ הרחיק מבורו של חברו ג' טפחים

אמר אביי ואיתימא רב יהודה מכותל בורו

שנינו שנמצא מרחיק מחלל הבור ששה טפחים (וליתני אלא אם כן הרחיק מבורו של חבירו שלשה טפחים) הא קמ"ל דכותל בור שלשה טפחים נפקא מינה למקח וממכר

כדתניא האומר לחבירו בור וכתליה אני מוכר לך צריך שיהא הכותל שלשה טפחים

It {=the first statement in the Mishna} began with a pit {of his neighbor} and ended with a wall! Let it teach "unless he distances from the wall of his fellow three handbreadths!" We thus learn that he should distance from the hollow of the pit six handbreadths. (* And let it teach "unless he distanced from the pit of his fellow three handbreaths. *) This informs us that the wall of a pit is three handbreadths, with a practical application to selling and buying.

As they learnt {in a brayta}: If a man says to another, 'I will sell you a pit and its walls,' the wall must be not less than three handbreadths thick.

Abaye said, and some say it was Rav Yehuda: From the wall of his pit.

It was stated {by Amoraim}: If a man desires to juxtapose {his pit} close up to the boundary {between his field and his neighbor's}, Abaye said that he may juxtapose; Rava said he may not juxtapose.

Regarding a field which is not made to have pits, all agree that he may juxtapose. Where do they argue? Regarding a field where pits would naturally be dug.

Abaye says he may juxtapose {his pit}, and even according to the Sages who say that one distances a {newly planted} tree from the pit 25 cubits, there it was at the time that he planted, the pit was already there. But here, at the time he dug, there was no pit {on the other side}.

And Rava said that he may not juxtapose, and even according to Rabbi Yossi who said that this may dig within his own {land} and this may plant within his own, there it was at a time such that when he planted,

the rental money {brought in} is split; but if they made it for their own use, then behold the rich brother can say to the poor one,

{Bava Batra 13b} "Take slaves and let them wash you down in the bath, take olives and make oil from them in the press."

We derive from this that there is no law of "name a price {for my share} or I will name a price."

And so it is difficult for Rav Yehuda.

ופרקינן שאני התם דגוד איכא אגוד ליכא

אבל אם היה העשיר תובע לעני ואומר לו גוד או אגוד הוה אמרי' ליה דינא קא"ל גוד ואי לית לך שבקיה ואיהו לגוד

כללא דמילתא היכא שהתובע אומר גוד או אגוד לא איכפת לן בנתבע אי אית ליה למיגד או לית ליה דאי לית ליה יניח לתובע לגוד

And we resolve that it is different there, for "name your price" there is, while "I will name a price" there is not.

There is one who maintains that it is clear from here that we only say "name a price or I will name a price" when both of them are able to buy. But at a time where one is a wealthy man and able to buy, while the other is a pauper and is not able to buy, we do not say "name a price or I will name a price."

And we do not maintain so. Rather, when the claimant says to the claimee "name a price or I will name a price," we say that he is telling him the law, and it does not matter to us regarding the claimee whether he has or does not have.

And out Mishna of two brothers, this is the reason, that the pauper is the claimant, and he is not able to say to the wealthy man "either you or I should name a price," for he cannot name a price. And therefore the law of "you name a price or I will name a price" is nullified, for the wealthy man can say, "I do not wish to name a price; you name a price." And since he does not have, the law of "name a price or I will name a price" is nullified.

But if the wealthy man was claiming against the pauper, and said to him "name a price or I will name a price," we say that he is telling him the law: name a price, and if you do not have, leave it and it he will name a price.

The rule of the matter is that where the claimant says "name a price or I will name a price," it does not matter to us regarding the claimee whether he has enough to name a price or not, we leave it to the claimant to name a price.

{Bava Batra 13b}

אמר אמימר הלכתא אית דינא דגוד או אגוד

ותניא נמי הכי כל שאילו יחלק ושמו עליו חולקין ואם לאו מעלין אותו בדמים
תניא טול אתה שיעור ואני פחות שומעין לו רשב"ג אומר אין שומעין לו

מ"ט דרשב"ג משום דאמר אי בדמי לית לי למיתן לך ואי במתנה לא ניחא לי

דכתיב ושונא מתנות יחיה

וקפסקי רבוותא דהלכתא כרשב"ג משום דמסתבר טעמיה:

Amemar said: The halacha is that there is a law of "name a price or I will name a price."

And a brayta also says so: Anything which if divided would still retain its name, they divide, and if not, they enter into it for its monetary value.

They learnt {in a brayta}: You take the {minimum} measure {namely, 4 cubits in the courtyard} and I, less, they listen to him. R' Shimon ben Gamliel says: They do not listen to him.

What is the reason of R' Shimon ben Gamliel? Because he {the one offered extra} can say, "if for money {which I must render to you}, I do not have to give to you. And if as a gift, I do not want this. For it is written {Mishlei 15:27}:

כז עֹכֵר בֵּיתוֹ, בּוֹצֵעַ בָּצַע; וְשׂוֹנֵא מַתָּנֹת יִחְיֶה.

27 He that is greedy of gain troubleth his own house; but he that hateth gifts shall live.

And the {post-Talmudic} Rabbis have ruled that the halacha is like R' Shimon ben Gamliel, because his reasoning makes sense.

ובכתבי הקדש אף על פי ששניהם רוצין לא יחלוקו:ש

אמר שמואל לא שנו אלא בכרך אחד אבל בשתי כריכות אם רצו לחלוק חולקין

ואם לאו אית דינא דגוד או אגוד

ודוקא לחלוק כגון תהלים ותורה אין חולקים אא"כ [רצו] דתרוייהו צריכי להאי ותרוייהו צריכי להאי אבל תהלים ותהלים תורה ותורה (לא) ע"כ חולקין (דמצי למימר ליה גוד או אגוד): ש

"AND REGARDING SCROLLS OF THE SCRIPTURE, THEY MAY NOT BE DIVIDED EVEN IF BOTH AGREE":

Shmuel said: They only learned this regarding one scroll, but if on two scrolls, if they wish to divide, they may divide.

And if not, there is the rule of "name a price or I will name a price."

And specifically to divide such as Tehillim and Torah, they do not divide unless both of them want, for both of them need this and both of them need this. But Tehillim and Tehillim, Torah and Torah (no), against his will they divide (for he is able to say to him "name a price or I will name a price").

Rav Ashi said to Amemar: But Ravin bar Chanina and Rav Dimi bar Chanina had to them two maidservants, one who knew how to bake and cook and one who knew how to spin and weave. They came to judgement before Rava and he said to them, "there is no rule {here} of "name a price or I will name a price."

He {=Amemar} said to him: It is different them, for this master would have liked to have both of them and this master would have liked to have both of them.

תנו רבנן מדביק אדם תורה ונביאים וכתובים כאחד דברי ר"מ

ורבי יהודה אומר תורה בפני עצמה ונביאים בפני עצמן וכתובים בפני עצמן

וחכמים אומרים כל אחד ואחד בפני עצמו

The Sages learnt {in a brayta}: It is permissible to fasten the Torah, Neviim and Ketuvim together. These are the words of Rabbi Meir. And Rabbi Yehuda says: Torah by itself, Neviim by themselves, and Ketuvim by themselves. And the Sages say: Each and every one my itself.

Rabbi said: There was an incident in which they brought before us a sefer Torah, Neviim, and Ketuvim fastened together as one, and we declared them valid.

And he should leave {as a space} in order to roll it the length of the {wooden} cylinder at the beginning and corresponding to the circumference at the end. And he places between each and every Chumash four lines. And so too between each and every Navi. And in the Navi of Twelve {Prophets}, three lines {between each}, and he begins at the top {of a column} and finishes at the bottom,

{Bava Batra 14a}

such that if he wants to cut {off one section}, he can cut.

תניא כל הספרים נגללין מתחלתן ס"ת היא נגללת לאמצעיתה ועושה לה עמוד אילך ועמוד אילך

They learnt {in a brayta}: Other books are rolled up from the beginning to the end {with but a single cylinder}, while a sefer Torah is rolled up to its middle, having a cylinder on this side and a cylinder on that side.

פרץ את פצימיו מטמא כל סביביו:

but if the posts have been taken down it does render unclean all the space around it.

א"ר ענן אמר שמואל מבואות המפולשות לרה"ר ובקשו בעלי מבואות להעמיד להן דלתות בני רה"ר מעכבים עליהם דזימני דדחקי בני רה"ר ועיילי להתם:ש

Rav Anan cited Shmuel: If the residents of alleyways which open out on to the public thoroughfare desire to set up doors at the entrance, the members of the public domain {who use the thoroughfares} can prevent them. For there are times that the members of the public domain are pressed and they enter there.

ש(אמר רבה בר בר חנה א"ר יוחנן מבואות המפולשות לעיר אחרת ובקשו בני מבוי לסתמן בני העיר אחרת מעכבין עליהם ואפילו איכא דרכא אחרינא): ש

(* Rabba bar bar Channa cited Rabbi Yochanan: If there are alleyways which are open {providing throughways} to another town, and the residents of the alleyway wish to close it, the residents of the other town can prevent them; and even where there is another path. *)

אמר רב יהודה אמר רב מצר שהחזיקו בו רבים אסור לקלקלו:

Rav Yehuda cited Rav: A field path to which the public have established a right of way must not be damaged.

ולא את השדה עד שיהא בו תשעת קבין לזה וכו':ש

ולא פליגי מר כי אתריה ומר כי אתריה:ש

"A FIELD SHOULD NOT BE DIVIDED UNLESS THERE WILL BE NINE KABS' SPACE TO EACH...":
And they do not argue; this one for his place, and this one for his place.

{Bava Batra 12b}

פשיטא חלק פשוט וחלק בכור יהבינן ליה אחד מצרא

יבם מאי

אמר אביי היא היא

ורבא אמר אמר קרא והיה הבכור הוייתו כבכור ואין חלוקתו כבכור

It is obvious that the portion {of a field} as a first-born and the portion assigned to him as an ordinary son should be contiguous. A yavam {who gets a first-born portion}, what?

Abaye said: It is the same.

And Rava said: Scriptures states {Devarim 25:6}

ו וְהָיָה, הַבְּכוֹר אֲשֶׁר תֵּלֵד--יָקוּם, עַל-שֵׁם אָחִיו הַמֵּת; וְלֹא-יִמָּחֶה שְׁמוֹ, מִיִּשְׂרָאֵל.

6 And it shall be, that the first-born that she beareth shall succeed in the name of his brother that is dead, that his name be not blotted out of Israel.

His being shall be as firstborn, but his portion shall not be as firstborn. {That is, he gets a double-portion, but cannot insist that it be contiguous.}

There was a certain person who bought land adjacent to that of his father-in-law. When they divided it {=the father-in-law's estable}, he said to them, "divide it up for me such that I have it on my border."

Rabba said: Such as this, we compel upon the trait of Sodom {such that we can insist that he receive this portion}.

Rav Yosef objected to this: The brothers may say to him We reckon this field as specially valuable like the property of the house of Bar Marion.

And the halacha is like Rav Yosef.

תרתי ארעתא חדא אהאי נגרא וחדא אהאי נגרא

אמר רבה כגון זה כופין על מדת סדום

מתקיף לה רב יוסף זימנין דהאי מדויל והאי לא מדויל

והלכתא כרב יוסף:

If there are two fields, one on this channel and one on that channel --

Rabba said: such as this, we force against the trait of Sodom {such that he can demand an adjacent field}.

Rav Yosef objected to him: There are times that one channel may continue running while the other dries up.

And the halacha is like Rav Yosef.

תרוייהו אחד נגרא

אמר רב יוסף כגון זה ודאי כופין על מדת סדום

מתקיף לה אביי בעינן לאפושי אריסי

והלכתא כרב יוסף אפושי אריסי ולא כלום היא:

If both of them were on one channel--

Rav Yosef said: such as this, we certainly force, against the trait of Sodom.

Abaye objected to this: {He can say} it requires more metayers.

And the halacha is like Rav Yosef; hiring more metayers is not considered anything.

{Bava Batra 13a}

חד גיסא נגרא וחד גיסא נהרא פלגי לה בקרנא זול (כגון זו):ש

On one side is a channel and on one side is a river, they divide it diagonally. (Such as this:)

ולא את הטרקלין ולא את המורן וכו':ש

אין בהן כדי לזה וכדי לזה מאי

אמר רב יהודה אית דינא דגוד או אגוד

ורב נחמן אמר לית דינא דגוד או אגוד

ת"ש שני אחים אחד עני ואחד עשיר והניח להן אביהם מרחץ ובית הבד אם עשאן לשכר

"NOR A HALL, NOR A DRAWING ROOM...":

If they are not large enough to leave sufficient space for both after division, what is the ruling?

Rav Yehuda said: He has {the right to say} "either you name a price {for my share} I will name a price {for yours}."

And Rav Nachman said: He does not have {the right to say} "either you name a price {for my share} I will name a price {for yours}."

Come and hear: If there are two brothers, one rich and one poor, to whom their father leaves a bath and an olive press, if he made them for renting,

{Bava Batra 11b}

ומרפסת יש להן ד"א

היו חמשה בתים פתוחים למרפסת אין להן אלא ד' אמות

and a balcony carry with them four cubits. If there are five rooms opening on to the balcony, they carry with them only four cubits between them.

גרסי' בסוכה בית שאין בו ד"א על ד' אמות פטור מן המזוזה ומן המעקה ואין האחים והשותפים חולקים בו דלא חזי לדירה:

We learn in Succah: A house which only has 4 cubits X 4 cubits is exempt from mezuzah and from the requirement to build a guardrail {on the roof}, and brothers and partners do not split it, for it is not fit for dwelling.

{Bava Batra 11b}

בית חציו מקורה וחציו אינו מקורה אין לו ארבע אמות

ואפילו קרויו לבר ולא מיבעיא קרויו מלגיו דעייל מלגואי ומפריק

If a room is half roofed over and half unroofed, it does not have four cubits. And even if the roofing is over the outer part, and it need not be said if the roofing is over the inner part, for it is possible for him to go right through and unload.

בעי מיניה רב הונא מרבי אמי אחד מבני מבוי שבקש להחזיר פתחו למבוי אחר בני מבוי מעכבין עליו או אין מעכבין עליו

Rav Huna inquired of Rabbi Ammi: If one of the residents of the alleyway desires to turn round his door to another alley-way, can the residents of this alley-way prevent him or can they not prevent him?

He {=Rabbi Ammi} said to him: The residents of this alley-way can prevent him.

"Is the achsania per capita or are they according to the number of doors?"

He {=Rabbi Ammi} said to him: Per capita.

A brayta also says so: The dung in the courtyard is divided according to doors; achsania per capita.

יש שפירשו זבל של אכסניא וגולפא ושדריא שדרך האכסנאים להניחם חולקים אותם בעלי האכסניא לפי בני אדם

ויש שפירשו אכסניא זו היא אכסניא של מלך או של עבדיו כשגובים אותם לפי בני אדם ולא לפי פתחים

There are those who explain, the dung of the achsania {animals of the guests} which they dig up and cast out, for it is the way of the guests to leave them -- the hosts of the guests split them according to the number of people.

And some explain that achsania is the achsania of the king, or his servants, when they collect them, it is in accordance with the number of people and not according to the number of doors.

האי דאמרינן בני מבוי מעכבין עליו ה"מ מבוי שאינו מפולש מפני שמרבה עליהן את הדרך אבל מבוי מפולש אין מעכבין עליו דהוה ליה רשות הרבים:

This that we said that residents of the alleyway can prevent him, these words are regarding an alley which is not open {on both sides}, since this would increase upon them the path, but an open alleyway, they cannot prevent him, for there is to him the public domain.

אמר רב הונא אחד מבני מבוי שבקש לסתום כנגד פתחו בני מבוי מעכבין עליו מפני שמרבה עליהן את הדרך

מיתיבי חמש חצרות הפתוחות למבוי כולן משתמשות עם החיצונה וחיצונה משתמשת לעצמה והשאר משתמשות עם השניה והשניה משתמשת לעצמה ומשתמשת עם החיצונה

נמצאת הפנימית משתמשת עם כולן ומשתמשת לעצמה

Rav Huna said: If one of the residents of an alley-way desires to fence in the space facing his door, the residents of the alleyway can prevent him, on the ground that he increases upon them the path.

They raised an objection {from a brayta}:

'If five [adjoining] courtyards open on an alley-way, all [the inner ones] share with the outside one the use [of the part facing it], but the outside one can use that part only. The remainder [the inner three] share with the second, but the second has the use only of the part facing itself and the outside one.
Thus the innermost one has sole use of the part facing itself and shares with all the others [the use of the part facing them].'

{So why can't he fence in that part, if the others have no right to use it?}

תנאי היא

דתניא אחד מבני מבוי שבקש להחזיר פתחו למקום אחר בני מבוי מעכבין עליו

היה סתום ובקש לפותחו אין בני מבוי מעכבין עליו

וחמש חצרות הפתוחות למבוי כולן משתמשות עם החיצונה והחיצונה משתמשת לעצמה והשאר משתמשות עם השניה והשניה משתמשת עם החיצונה ומשתמשת לעצמה נמצאת פנימית משתמשת עם כולן ומשתמשת לעצמה דברי רבי

ר' שמעון בן אלעזר אומר חמש חצרות הפתוחות למבוי כולן משתמשות במבוי

It is a matter of Tannaitic dispute. For they learnt {in a brayta}:

If one of the residents of an alley-way desires to open a door on to another alley-way, the residents of that alley-way can prevent him. If, however, he only desires to reopen there one which had been closed, they cannot prevent him.

And {filling in a chasurei mechsera, } if five [adjoining] courtyards open on an alley-way, all [the inner ones] share with the outside one the use [of the part facing it], but the outside one can use that part only. The remainder [the inner three] share with the second, but the second has the use only of the part facing itself and the outside one. Thus the innermost one has sole use of the part facing itself and shares with all the others [the use of the part facing them]. These are the words of Rabbi.

R' Shimon ben Eleazar says: if five courtyards open on to an alley-way, they all share the use of the alley-way.

וקם ליה רב הונא כרבי שמעון בן אלעזר

וליתא לדרב הונא דהא דרבי פליגא עליה דרבי שמעון בן אלעזר וקיימא לן הלכה כרבי מחברו:

And Rav Huna establishes like Rabbi Shimon ben Eleazar. And we do not hold like Rav Huna, for Rabbi argues upon Rabbi Shimon ben Eleazar; and we establish that the halacha is like Rabbi over his colleague.

היה סתום ובקש לפותחו אין בני מבוי מעכבין עליו

אמר רבה לא שנו אלא שלא פרץ את פצימיו אבל פרץ את פצימיו בני מבוי מעכבין עליו

א"ל אביי לרבה תניא דמסייעא לך בית סתום יש לו ארבע אמות

פרץ את פצימיו אין לו ד' אמות

בית סתום אינו מטמא כל סביביו

{Earlier we said} 'If he desires to reopen a door which has been closed, the residents of the other courtyard cannot prevent him.'

Rabba {our gemara: Rava} said: They only learned this where he had not taken down the posts of the closed door {demonstrating he intended to eventually reopen it}, but if he had taken down the posts of the closed door, the residents of the courtyard can prevent him reopening it.

Abaye said to Rabba {our gemara: Rava}: There is a brayta in support of you:

A room that is shut up carries with it four cubits in the courtyard, but if the posts [of the door] have been taken down, it does not carry with it four cubits. If a room is shut up it does not render unclean all the space around it,
